1. Introduction
Planify Limited (“we”, “us”) is committed to protecting your privacy. This policy details how we process personal data in connection with our Platform (app.planify.ie). We act as a Data Controller for user account data and a Data Processor/Aggregator for public planning data.
2. The Data We Collect
A. Data You Provide (User Data)

Identity: Name, Email address.

Financial: Payment history (Card details are handled securely by Stripe; we do not see full card numbers).

Profile: Profession (e.g., Architect, Developer), Location preferences.

Communications: WhatsApp number (if alerts enabled).

Content: Comments posted on the public feedback module.
B. Data We Aggregate (Public Planning Data)
Planify aggregates data from public planning files. This may include:

Names and addresses of applicants/agents (as published by Local Authorities).

Observations/Objections lodged on files.

Legal Basis: We process this data based on Legitimate Interest (providing a searchable database of public record information to facilitate transparency in the planning system) and pursuant to the Open Data Directive.
C. Automatically Collected Data

Technical: IP address, device type, browser version.

Usage: Search history, clicked properties, heatmaps viewed.
3. How We Use Your Data
We process your data to:

Provide the Service: Grant access, display maps, and run searches.

Send Alerts: Notify you of planning changes via Email (Postmark) or WhatsApp.

AI Analysis: To generate reports. Note: We do not use your personal search history to train public AI models.

Billing: Process subscriptions via Stripe.

Security: Detect fraud or account sharing via Clerk.
4. AI and Automated Decision Making

AI Reports: When you request a report, we send the relevant planning data to our AI providers (e.g., OpenAI). This data is not used by them to train their models.

Automated Profiling: We use algorithms to suggest, eg “High Potential Sites” This is based on data aggregation, not personal profiling of you as a user.
5. Third-Party Processors
We share data with trusted sub-processors to run our app:

Clerk: Authentication & User Management.

Stripe: Payments.

Postmark: Transactional Emails.

Meta (WhatsApp API): Delivery of mobile alerts.

AWS: Hosting and Database infrastructure.

OpenAI / OpenRouter: AI Text Generation.
All providers are vetted for GDPR compliance. Transfers to the US rely on the EU-US Data Privacy Framework or Standard Contractual Clauses (SCCs).
6. Public Planning Data & The “Right to be Forgotten”
Important Note regarding Planning Files: Information contained in planning applications is a matter of public record required by law. While Planify makes this data easier to search, we do not create the data.

If you wish to have personal data removed from a planning file, you must contact the relevant Local Authority directly.

If a Local Authority removes data from the public record, our systems (which update regularly) will reflect this removal in due course.
7. Data Security
We utilise enterprise-grade security:

Encryption in transit (SSL/TLS) and at rest.

Regular database backups.
8. Your Rights (GDPR)
You have the right to:

Access: Request a copy of your data.

Rectify: Correct errors in your account.

Erase: Request account deletion (User Data).
